- Eligibility, Device & Compatibility:
- You must be at least 18 years old and capable of entering into a binding contract to use the Service.
- The Mapperty Spaceview iOS app currently requires a LiDAR-capable iPhone to capture scans. iPhones or other iOS devices without LiDAR may not be able to perform scans through the app.
- You may still access your account and upload project files using the web portal at www.mapperty.com, even if your device cannot perform scans.
- You are responsible for ensuring your device, operating system, and network connection are compatible with the Service.
- Use of the Service:
- You agree to use the Service only for lawful purposes and in accordance with these Terms.
- You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
- You must provide accurate, current, and complete information when creating an account or submitting a project/order request.
- Projects, Scans, Files & Deliverables:
The Service, including the Mapperty Spaceview iOS app and the web portal at www.mapperty.com, allows you to request 2D and 3D models and documentation (“Deliverables”) for specific properties.

4.1 Project Creation:
When you create a project, you may be asked for information such as:- Property type (e.g., single-family residence, commercial, showroom, etc.)
- Property address
- Approximate area and number of floors
- Purpose of the model (e.g., interior design/renovation, documentation, marketing visuals)

4.2 Scans & Uploads:
You can provide project data in several ways:-
LiDAR scanning via iOS app
- Scan the interior and/or exterior of the property using a LiDAR-capable iPhone.
- For multi-story buildings, you may scan each floor separately to support accurate stacked models.

File uploads via iOS app
- Existing floor plans (PDF, AutoCAD DWG, Revit RVT).
- Existing CAD/BIM or 3D models.
- LiDAR / point-cloud files (e.g., USDZ, LAS, LAZ, XYZ, E57, and similar formats, if you already have them).
- Photos captured directly in the app (e.g., exterior and interior images).
- Any additional supporting project documents.

File uploads via web portal
- By logging in to your account at www.mapperty.com → Mapperty Spaceview,you can open the same project and upload files that live on your computer or cloud storage (plans, older Revit/CAD files, PDFs, images, etc.).
You are solely responsible for ensuring that all data and documents you submit are accurate, complete, and up to date. The accuracy and quality of the Deliverables depend on the quality of the input data you provide.

4.3 Deliverables:
Based on your scans, uploaded files, and instructions, Mapperty will use commercially reasonable efforts to prepare Deliverables, which may include:- Revit models (.rvt)
- AutoCAD drawings (.dwg)
- 3D models or BIM packages (“Models”)
- PDF drawings and documentation (e.g., floor plans, elevations, sections, or permit-style sets if requested)
The specific Deliverables for each project depend on the options you select (e.g., Level of Detail, file formats, and documentation requirements).

4.1 Project Creation:
- Order Flow & Statuses:
After you submit your project details, scans, and files through the app or web portal, we will follow an internal review and production flow. The Service may display status labels such as:
- “Under Review” – We are reviewing your scans, files, and requested scope.
- “Quote Received” – We have issued a quote and estimated delivery timeframe, visible in your Order Details / Order Summary.
- “Model in Production” – You have accepted the quote, paid, and we have started working on your model.
- “Model Received” / “Latest Delivery” – Initial Deliverables are ready for download.
- “Revised Files Ready” – Revised Deliverables are ready for download after your revision request.
- Revisions:
- Each order includes three (3) free revisions after initial delivery, provided that the revision requests are submitted within seven (7) days of the initial delivery date shown in your Order Details.
- Revisions are intended for reasonable adjustments within the original scope of work (for example, minor corrections, clarifications, or small layout changes).
- Requests that significantly change the scope (e.g., additional areas or floors, substantially higher Level of Detail, or a new model purpose) may be treated as a new order that requires a new quote and payment.
- Once you either:
- Use all three free revisions, or
- Exceed the 7-day revision window, the project may be marked as locked. When a project is locked:
- You can still download all Deliverables and
- Use the Project Discussion features,
- But further edits or changes may require a new order and a separate quote and payment.
- Payment Obligations:
- When you first submit a project, any “Estimated Delivery Date” or “Estimated Cost” shown as N/A or tentative is not final. These fields are finalized only after our review.
- After review, we will issue a quote and an estimated delivery date. You can view these under “Quote Received” in the Order Details / Order Summary.
- If you accept the quote, you must complete payment through the Service’s integrated payment flow.
- We do not start modeling work (“Model in Production”) until payment for the quoted amount has been successfully processed.
- All payments are processed through Stripe or another payment processor we designate. By providing your payment information, you authorize Mapperty Inc. and the payment processor to charge the invoiced amount.
- Non-Refundable Payments:
- Unless otherwise required by applicable law or expressly agreed in writing, amounts paid for a project become non-refundable once we have started work on your order.
- Because payment occurs before production, refunds are generally not available after your payment has been processed and your order has moved into production.
- You are responsible for reviewing your scope, options (LOD, file formats, etc.), and the quoted price before confirming payment.
- Access to Deliverables:
- After payment and completion of production, your Deliverables will be made available for download within your account, typically under a status such as “Model Received” or “Latest Delivery”.
- When revisions are completed, updated Deliverables will be available when the status indicates “Revised Files Ready”.
- Access to Deliverables and revision files is contingent upon full payment of all applicable fees and your continued compliance with these Terms.
- Late Payment or Non-Payment:
- If you fail to pay for:
- Additional quoted work; or
- Extra revisions outside the included revision allowance, we may delay or refuse to begin such work and may withhold release of any new or revised Deliverables.
- We may also restrict your ability to place new orders or access certain features until unpaid amounts are resolved.
- You remain responsible for all outstanding amounts, even if we suspend or limit access to portions of the Service.
- If you fail to pay for:
- Disputed Charges:
- You must notify Mapperty Inc. of any disputed charges within 30 days from the date of the charge. Disputes raised after this period may not be considered.
- If you initiate a dispute or chargeback with your bank or payment provider without first contacting Mapperty Inc. to attempt resolution, we may suspend or limit your account while the dispute is reviewed.
- Intellectual Property:
- The Service, including all software, interfaces, workflows, text, graphics, and other content, is owned by or licensed to Mapperty Inc. and is protected by intellectual property laws.
- Subject to these Terms and your full payment of applicable fees, Mapperty grants you a limited, non-exclusive, non-transferable license to use the Deliverables for your internal business or project purposes.
- Except as expressly permitted by these Terms or in a separate written agreement, you may not copy, modify, distribute, resell, publicly display, or create derivative works from the Service or any of its components.
- Prohibited Uses:
You agree not to:- Use the Service for any illegal, fraudulent, or unauthorized purpose;
- Attempt to gain unauthorized access to the Service, other user accounts, or Mapperty systems;
- Upload or transmit any viruses, malware, or harmful code;
- Reverse engineer, decompile, or otherwise attempt to derive the source code of the Service, except where such restriction is prohibited by law.
- Disclaimer of Warranties:
- The Service and all Deliverables are provided on an “as is” and “as available” basis.
- Mapperty makes no warranties of any kind, express or implied, including but not limited to warranties of accuracy, completeness, fitness for a particular purpose, or non-infringement.
- Deliverables are based on the data and instructions you provide and may not perfectly reflect as-built conditions, actual construction, or regulatory approvals.
- Limitation of Liability:
- To the maximum extent permitted by law, Mapperty Inc. and its officers, employees, and agents shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising out of or related to your use of the Service or Deliverables.
- In no event will Mapperty’s total liability for all claims relating to the Service exceed the amount you paid to Mapperty for the specific order giving rise to the claim.
- Indemnification:
- You agree to indemnify, defend, and hold harmless Mapperty Inc., its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- Your use of the Service or Deliverables;
- Your breach of these Terms; or
- Any data, files, scans, or other content you submit or upload through the Service.
- You agree to indemnify, defend, and hold harmless Mapperty Inc., its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- Governing Law & Jurisdiction:
These Terms are governed by and construed in accordance with the laws of the State of Florida, USA, without regard to conflict-of-law principles. Any disputes arising out of or in connection with the Service or these Terms shall be brought exclusively in the state or federal courts located in Florida, USA, and you consent to the jurisdiction of such courts.
- Changes to the Service and Terms:
We may update or modify the Service from time to time, including by adding or removing features. We may also update these Terms periodically. When we do, we will revise the Effective date at the top of this page. Your continued use of the Service after any such changes constitutes your acceptance of the updated Terms.
